Terms & Conditions

NZ Edition 1.0
Effective Date: 30 October 2026

1. Introduction and definitions

Welcome to coachjames.co.nz (the “Website”). These Terms govern the Website and the coaching, training, online courses and related services offered by Coach James (“Coach James”, “we”, “us” or “our”). Coach James is an Australian-based business providing services to clients in New Zealand remotely. Use of a New Zealand website or telephone number does not mean that Coach James maintains a physical New Zealand office.

By booking a service, purchasing a course, accepting a proposal or engagement agreement, or using the Website, a client agrees to the applicable Terms to the extent permitted by law. Website browsing alone does not create a paid coaching engagement.

Client means an individual or organisation purchasing or engaging services. Participant means a person receiving services on behalf of a Client. Engagement Agreement includes an accepted proposal, statement of work, coaching agreement, booking confirmation or written service agreement. Services means the professional services, courses and resources supplied by Coach James.

2. Services and online delivery

Services offered through this Website may include executive and leadership coaching, Christian executive coaching, career clarity and career transition coaching, redundancy and job-search support, interview coaching, one-to-one or group online coaching, and Ready to Answer™ Online courses and downloadable educational resources.

New Zealand services are delivered online unless a separate written agreement explicitly states otherwise. The Ready to Answer™ school-delivery program is not offered through this Website. Available services, inclusions, durations and pricing are as described at booking or in the applicable Engagement Agreement.

Coaching and training are intended to support insight, skills, preparation and action. No particular job offer, promotion, interview outcome, business improvement, financial outcome or other result is guaranteed.

3. Engagement agreements and priority

An Engagement Agreement may specify scope, scheduled sessions, participants, resources, fees, payment terms, confidentiality boundaries and cancellation arrangements. Specific terms agreed in writing prevail over these general Terms to the extent of an inconsistency, but neither document excludes legal rights that cannot be excluded.

The version of these Terms applicable when an engagement is accepted ordinarily continues to apply unless the parties agree to a lawful variation.

4. Client and participant responsibilities

Clients agree to provide accurate information, communicate respectfully, attend or reschedule bookings as agreed, pay applicable fees, and use coaching materials lawfully. Clients and Participants are responsible for maintaining suitable equipment, internet access and a private setting for online sessions.

Clients should not disclose confidential employer, candidate or third-party information without authorisation, and should avoid providing unnecessary sensitive personal information.

5. Coaching and interview preparation

Coaching is collaborative. Coach James may offer questions, challenge, feedback, mentoring, practice, planning and accountability, but the Client remains responsible for their decisions, actions and representations.

Interview coaching and online interview-preparation courses may include practice questions, mock interviews, structured answer methods including TRAIL™, preparation strategies and feedback. Actual interviews and selection criteria may differ. Coach James does not act as a recruiter or guarantee a recruitment outcome.

Clients must present their qualifications, work history, examples and interview answers accurately. Coach James will not knowingly assist deliberate misrepresentation or fabrication.

6. Ready to Answer™ Online and digital resources

Ready to Answer™ Online is a self-paced digital learning offering. The course description and checkout specify its content, access conditions, and any included downloadable resources. Purchasing a course does not include personal coaching unless the offer expressly states otherwise; any optional graduate coaching session is a separate purchase.

Course logins are for the registered learner’s individual use unless otherwise agreed in writing. Learners must not share access credentials, redistribute files or reproduce course materials beyond permitted personal use.

We will take reasonable steps to provide purchased course access and remedy genuine access problems. Applicable consumer rights remain unaffected.

7. Professional services disclaimer

Services are for coaching, learning and professional development, not medical, psychological, psychiatric, legal, migration, accounting or financial advice. Clients should obtain regulated professional advice when required, including in relation to redundancy entitlements, employment disputes or immigration matters.

8. Fees, currencies, taxes and payments

Unless clearly stated otherwise, prices shown on this New Zealand Website are in New Zealand dollars (NZD). The checkout or Engagement Agreement will identify the amount payable, currency and any applicable taxes. NZ GST will be charged if and when required under applicable law; descriptions of tax in a particular offer or invoice prevail over general wording here.

Payment may be required at booking or purchase and may be processed through Stripe, CoachAccountable or another approved provider. Organisational engagements may be invoiced or paid by bank transfer under a separate agreement. Payment is treated as received when cleared or confirmed by the payment provider.

If the payment processor or issuing bank converts currency, that provider may apply exchange rates or fees outside Coach James’ control; clients should check the currency presented before confirming payment.

9. Payment plans and recurring payments

If a payment plan or subscription is expressly offered, its payment schedule, ongoing charges and cancellation process will be shown at purchase or in the relevant Engagement Agreement. A failed payment may lead to reasonable suspension of future access or services, subject to applicable law and any agreed cure period.

10. Rescheduling and cancellations

Individual live coaching: Please provide at least 24 hours’ notice to reschedule. With timely notice, Coach James will make reasonable efforts to arrange another time. A late cancellation or unattended session may be treated as used where this is fair, clearly disclosed at booking and permitted by law; individual circumstances, including illness and emergencies, may be considered.

If Coach James cancels a booked session, the Client will be offered a reasonable replacement time or an appropriate refund for the undelivered session, consistent with applicable legal rights.

Organisational online engagements: Any agreed cancellation fees, committed preparation costs and rescheduling conditions will be specified in the Engagement Agreement and must be lawful, reasonable and proportionate.

11. Refunds and statutory consumer rights

Change-of-mind refunds are not automatically available after an individual session has been delivered or digital course access has been provided, unless a particular offer promises otherwise. However, nothing in these Terms limits any right to a refund, remedy, repeat performance or other relief under a law that applies to the transaction, including the New Zealand Consumer Guarantees Act 1993 or Fair Trading Act 1986 where applicable, or the Australian Consumer Law where applicable.

If a service or digital product is defective, not supplied as agreed, or otherwise fails to meet an applicable legal guarantee, please contact Coach James to discuss an appropriate remedy. We will assess concerns fairly and promptly.

12. Third-party platforms and overseas operations

Coach James uses third-party providers as reasonably necessary to deliver and administer services, which may include Squarespace, CoachAccountable, Stripe, Google Workspace and Google Meet, Amazon Connect and analytics or communication providers. Some providers and information processing facilities are located outside New Zealand, including in Australia or other countries.

Details of personal information handling, disclosures and cross-border safeguards are provided in the Privacy Policy. Third-party services may be governed by their own terms and privacy notices.

13. Privacy and confidentiality

Coach James will handle personal information under its published Privacy Policy and applicable privacy laws, which may include the New Zealand Privacy Act 2020 and relevant Australian law. Personal information is collected for appropriate purposes such as enquiries, bookings, delivery, payment, records and client communication.

Individual coaching discussions are treated as confidential, except where disclosure is authorised, required by law, reasonably necessary for service administration, or reasonably required in response to a serious safety concern. In employer-sponsored coaching, any reporting boundaries should be agreed in writing. In group sessions, Coach James cannot guarantee other participants’ confidentiality.

Neither party should record a live session without prior agreement and any legally required consent.

14. Intellectual property and permitted use

Coach James or its licensors retain ownership of its materials and intellectual property, including Ready to Answer™, TRAIL™, coaching methods, course content, videos, slides, workbooks, printable playbooks, worksheets, templates, website content and branding.

Clients receive a limited, personal, non-exclusive, non-transferable licence to use purchased or provided resources for their own learning or development, unless expressly agreed otherwise. Materials may not be redistributed, resold, uploaded publicly, republished, adapted for separate commercial delivery or used to train others to deliver Coach James programs without written permission, subject to any rights granted by law.

15. Website availability and technical requirements

Coach James takes reasonable steps to maintain its Website and online offerings but does not guarantee uninterrupted availability. Clients should notify us promptly of material access difficulties. Technical failures will be addressed reasonably, including through an appropriate remedy where required by law.

16. Responsibility and limitation of liability

Clients remain responsible for their own decisions and actions. To the extent permitted by applicable law, Coach James is not responsible for losses arising solely from independent decisions made by Clients or from circumstances outside Coach James’ reasonable control.

Nothing in these Terms excludes or restricts any non-excludable statutory guarantee, remedy or liability. Any proposed limitation applicable to a particular business engagement must be lawful and, where appropriate, agreed separately in writing.

17. Circumstances beyond reasonable control

If illness, emergency, power or internet failure, natural disaster or another event beyond reasonable control materially disrupts delivery, the parties will communicate promptly and seek a reasonable rescheduling or alternative arrangement. Rights to refunds or other remedies required by law are unaffected.

18. Changes to these Terms

Coach James may revise these Terms for future bookings and purchases by publishing a new version and effective date. Changes do not retrospectively alter accepted engagements unless the parties lawfully agree otherwise.

19. Complaints, disputes and governing law

Clients are encouraged to raise concerns directly with Coach James first so that we can attempt a prompt, good-faith resolution. This does not prevent a Client from using any available consumer protection, regulatory or court process.

As Coach James operates from New South Wales, Australia, these Terms are intended to be governed by the laws of New South Wales, subject to any mandatory laws and consumer protections that apply to New Zealand clients or the transaction. The parties submit to the non-exclusive jurisdiction of courts with competent jurisdiction; this clause does not deprive Clients of legal avenues that cannot be excluded.

20. Contact

For questions about these Terms, bookings, course access or complaints, contact Coach James using the details on the New Zealand Contact page.
